A public contract is a contract concluded for pecuniary interest between a contracting authority (public purchaser) and a public or private entity which meets the requirements of the contracting authority for supplies, services or constructions.
A public contract must respect a set of rules that allows a buyer in the public sector (contracting authority) to make the choice of the supplier most likely to obtain the constructions, supplies or services he requires.
The various procedures are:
- Competitive dialogue procedure
- Open or restricted procedure
- Negotiated procedure
- Adapted procedure
The purpose of all this procedures is to ensure the competitiveness between most of the companies in order to provide supplies or services
In what concerns the health sector, the main public purchasers are: hospitals, healthcare centers, teaching hospitals, the public hospitals systems of Paris (AP-HP), nursing homes (EHPAD), purchasing groups such as UGAP, UNI-HA, RESA-IDF but also SDIS (fire brigade), CCAS (health and social work services) and ultimately medical research facilities: the French National Institute of Health and Medical Research (INSERM), the French National Center for Scientific Research (CNRS), Universities, the French National Institute of Agricultural Research (INRA)…
The applicable rules are regrouped in a code: the French Code of Public Procurements (CMP) and concerns any purchase of an amount greater than € 25 000 pre-tax prices.
The latest edition of the Code dates from 2006 and has since been updated several times.
To answer a public tender, the company must be possible to certify that it is up to date with its social contributions: the Social Security and Family Allowance Contribution Collection Office (URSSAF) and its taxes (VAT, IS (corporate income tax)).
