A contract notice regarding the purchase of a medical device, sterile or non-sterile consumable medical devices, medicines, a service is distributed by a hospital, a hospital center, a University Hospital Centre / Regional University Hospital Centre (CHU / CHRU), a retirement home, a nursing home (EHPAD), a town hall ... and for medical research by the French National Institute of Health and Medical Research (INSERM), the French National Center for Scientific Research (CNRS), the University, and the National Institute of Agricultural Research (INRA)...

A public purchaser is not entitled to contact the suppliers liable to support his purchase request, on pain of being convicted of "offense of favoritism "; this has led to the cancellation of the “purchase”.

A public purchaser intending to purchase a product or service must issue an advertising notice called: a notice of a competitive public tender (AAPC).

The French Code of Public Procurements (CMP) sets very precise rules concerning the publication of the contract notices.

For purchases estimated at:
-> € 25 000 and < € 90 000 pre-tax price, the contract notice must be published on an "appropriate platform" depending on the nature of the purchase. The most common are hospital or health-specific Internet sites.
-> € 90 000 and < € 209 000 pre-tax price (or € 5 225 000 pre-tax price for works contracts), the contract notice must be published in a newspaper for legal notices (JAL) such as the regional press or BOAMP (The Official Gazette of Public Contracts Announcements in France) published by the OJ (Official Journals);
-> € 209 000 pre-tax price (or € 5 225 000 pre-tax price for works contracts), the contract notice must be published in the BOAMP (The Official Gazette of Public Contracts Announcements) edited by the Official Journal (OJ) and the Official Journal of the European Union (OJEU).
